Hollywood Video and you agree that any controversy, claim, or dispute arising out of or relating in any way to your purchase, use or ownership of this card shall be settled by final, binding arbitration before a single arbitrator in Multnomah County, Oregon. Nothing contained in this arbitration provision shall preclude Hollywood Video or you from resolving in Small Claims Court any controversy, claim, or dispute over which the Small Claims Court has jurisdiction. The arbitration shall be administered under the rules of the American Arbitration Association (AAA) including its Consumer Due Process Protocol. The arbitration shall be conducted by an AAA arbitrator selected under the AAA rules. If you commence the arbitration, Hollywood Video will pay that portion of the AAA's filing fee that exceeds the cost of filing an action in the court of general jurisdiction in the county where the arbitration takes place. The law of the State of Oregon shall apply in the arbitration. If you elect to arbitrate a claim against Hollywood Video and prevail, Hollywood Video agrees to reimburse you for the arbitration filing fee and any other costs of the arbitration paid by you (not including attorney fees). Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. You may obtain additional information about arbitration procedures by visiting the AAA website (www.adr.org). If Hollywood Video or you file a judicial or administrative action asserting a claim that is subject to arbitration (other than in Small Claims Court) and the other party successfully stays such action or compels arbitration, the party filing that action agrees to pay the other party's costs and expenses in seeking such stay or compelling arbitration, including attorneys fees.
